Welcome to Espresso Mafia.

This website and online store are operated by Los Dos Molinillos Girona S.L., trading as Espresso Mafia ("Espresso Mafia", "we", "us" or "our").

Our online store is powered by Shopify, which provides the e-commerce platform that allows us to offer and sell our products and services to you.

These Terms of Service ("Terms") govern your access to and use of our website, online store and related services (collectively, the "Services"), as well as purchases made through our online store.

By accessing our website or purchasing from us, you agree to these Terms and our Privacy Policy.

Please read these Terms carefully before using our Services or placing an order.

Nothing in these Terms is intended to exclude, restrict or limit any rights granted to consumers under applicable Spanish or European Union consumer protection law.

SECTION 1 — ACCESS AND ELIGIBILITY

By using our Services or placing an order, you confirm that you have the legal capacity to enter into a binding contract under the laws applicable to you.

When placing an order, you may be required to provide information including your name, email address, billing information, payment details and shipping address.

You agree that all information provided by you is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to display and describe our products as accurately as possible.

However, product colours and appearance may vary slightly depending on your device, screen settings, lighting and other factors outside our control.

Coffee is a natural agricultural product. Characteristics such as colour, appearance and sensory profile may therefore vary slightly between harvests, lots and roasting batches.

Product descriptions, availability and specifications may be updated from time to time.

We reserve the right to discontinue products or limit product quantities where reasonably necessary.

Nothing in this section affects your statutory rights where a product is defective, damaged, incorrectly supplied or otherwise does not conform to the purchase contract.

SECTION 3 — ORDERS

When you place an order through our online store, you are making an offer to purchase the products in your order.

An order is accepted once we confirm acceptance and payment has been successfully processed.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases of product unavailability, incorrect pricing or product information, suspected fraud, payment problems or other legitimate reasons.

If we cancel an order after payment has been received, we will refund the relevant amount using the original payment method.

Please review your order carefully before submitting it.

Once an order has been accepted or entered into preparation, we may not be able to accommodate voluntary cancellation requests.

This does not affect any statutory cancellation or withdrawal rights that may apply under Spanish or European Union consumer law.

Purchases are also subject to our Returns & Refunds Policy.

SECTION 4 — PRICES, VAT AND PAYMENT

All prices displayed in our online store are shown in euros (€), unless otherwise indicated.

For consumer purchases within the European Union, displayed prices include applicable VAT unless expressly stated otherwise.

Any applicable shipping costs or additional charges will be displayed during checkout before you complete your purchase.

For deliveries outside the European Union, additional customs duties, import taxes or other charges may apply. Unless otherwise stated, these charges are not included in the purchase price and may be payable by the recipient in accordance with the rules of the destination country.

Prices, promotions and discounts may change from time to time. The price applicable to your purchase will be the price displayed when your order is placed, subject to correction of obvious errors.

You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the payment method provided.

SECTION 5 — SHIPPING AND DELIVERY

We will deliver orders to the shipping address provided during checkout.

Delivery times displayed on our website are estimates and may be affected by circumstances outside our reasonable control.

We are not responsible for delays directly caused by carriers, customs authorities or events outside our reasonable control. However, nothing in these Terms limits any statutory rights you may have in relation to delayed, lost or undelivered orders.

For consumer purchases, risk of loss or damage to the products passes to you when you, or a third party designated by you other than the carrier, acquire physical possession of the products, except where otherwise provided by applicable law.

You are responsible for providing a complete and accurate delivery address when placing your order.

SECTION 6 — RETURNS, REFUNDS AND INCORRECT PRODUCTS

Returns, refunds and order issues are governed by our Returns & Refunds Policy and applicable consumer protection law.

Except where required by applicable law, we do not offer voluntary returns or refunds for change-of-mind purchases.

Due to the nature of our coffee and food products, opened products cannot be returned or refunded except where required by applicable law, including where a product is defective or otherwise does not conform to the contract.

If a cup arrives broken, please contact us at espressomafiagirona@gmail.com. Once the damage has been verified, we will refund the purchase price of the affected cup. We do not send replacement cups for broken items.

If you receive a product different from the product you ordered, please contact us at espressomafiagirona@gmail.com. Once the issue has been verified, we will arrange for the correct product to be sent to you.

Nothing in this section limits or excludes any mandatory rights you may have under applicable consumer protection law.

SECTION 7 — RIGHT OF WITHDRAWAL

Where applicable under Spanish and European Union consumer law, consumers purchasing online may have the right to withdraw from an eligible purchase within 14 days of receiving the goods, without giving a reason.

Certain products may be legally excluded from the right of withdrawal, including, where applicable, goods liable to deteriorate or expire rapidly and sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed.

Where the statutory right of withdrawal applies, you must notify us within the applicable withdrawal period.

SECTION 8 — DAMAGED OR NON-CONFORMING PRODUCTS

Please inspect your order after delivery and contact us as soon as reasonably possible if you believe that a product is damaged, defective, incorrectly supplied or otherwise does not conform to your order.

We may request reasonable evidence, such as photographs of the product and packaging, in order to evaluate the issue.

Any remedies available for defective or non-conforming products will be provided in accordance with applicable Spanish and European Union consumer protection law.

Our commercial Returns & Refunds Policy does not limit any mandatory legal guarantee or remedy available to you.

SECTION 9 — INTELLECTUAL PROPERTY

The content available through our Services, including trademarks, trade names, logos, text, photographs, graphics, illustrations, videos, audio, website design and other materials, is owned by or licensed to Los Dos Molinillos Girona S.L., Espresso Mafia or the respective rights holder and is protected by applicable intellectual property laws.

You may use the website and its content for personal and non-commercial purposes.

Unless permitted by law or expressly authorised by us, you may not reproduce, distribute, modify, publish, commercially exploit or otherwise use our protected content without prior written permission.

The Espresso Mafia name, logo and related branding may not be used without appropriate authorisation.

Shopify's names, trademarks and branding remain the property of Shopify or its respective rights holders.

SECTION 10 — THIRD-PARTY SERVICES AND LINKS

Our Services may contain links to, integrations with or functionality provided by third parties.

We are not responsible for the content, accuracy, availability or practices of independent third-party websites or services.

When you access a third-party service, its own terms, conditions and privacy policies may apply.

Nothing in this section limits any liability that cannot legally be excluded.

SECTION 11 — RELATIONSHIP WITH SHOPIFY

Espresso Mafia is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our online store are made directly with Los Dos Molinillos Girona S.L., trading as Espresso Mafia.

Shopify is the technology provider for our online store and is not the seller of the products purchased from Espresso Mafia.

Your use of Shopify-related functionality may also be subject to applicable Shopify terms and privacy practices.

SECTION 12 — PRIVACY AND PERSONAL DATA

We process personal information in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR) and applicable Spanish data protection law.
